These Terms and Conditions govern the use of the certified email service offered through the LegallyMail website (hereinafter, "the Service"), owned by Cowabi Ltd, with Company Number: 10092807 and registered office at 165-167 Great Portland Street, 5th Floor, London W1W 5PF (hereinafter, "LegallyMail", "we" or "our").

By registering and/or using our Service, you agree to be bound by these Terms and Conditions. If you do not agree to any part of the terms, you may not access the Service.

2. Definitions

• User: Any individual or legal entity that registers and uses the Service.
• Certified Email: Service that allows the sending of electronic communications with legal validity, providing evidence of content, sender, recipient, date and time of sending and receipt.
• Certification: Process by which electronic communications are given legal validity.
• Platform: The website and all associated services offered by LegallyMail.

3. Service Description

LegallyMail offers a certified email service that allows users to send electronic communications with legal validity, generating evidence about:

• The identity of the sender
• The complete content of the message and its attachments
• The exact date and time of sending
• Receipt by the recipient
• The date and time of opening (when technically possible)

This evidence is stored securely and can be used as proof in judicial or administrative proceedings, in accordance with applicable legislation.

4. Registration and User Accounts

To use our Service, you must register by providing accurate, complete and up-to-date information. You are responsible for maintaining the confidentiality of your account and password, as well as restricting access to your computer and devices. You agree to assume responsibility for all activities that occur under your account and password.

LegallyMail reserves the right to refuse service, close accounts, delete or edit content, or cancel orders at its sole discretion, especially if there are reasons to believe that the account is being used for fraudulent or illegal activities.

5. Subscription Plans and Payments

By subscribing to a paid plan or making a purchase, you agree to pay the applicable fees at the time of billing. Payments are non-refundable unless applicable law provides otherwise or in case of significant Service interruption attributable to LegallyMail.

We reserve the right to modify fees and pricing structures at any time, notifying users with sufficient advance notice.

6. Usage Rights and Restrictions

The following uses of the Service are expressly prohibited:

• Sending spam, unsolicited emails or non-consensual mass communications.
• Transmitting viruses, malware or any malicious code.
• Sending illegal, defamatory, offensive, obscene content or content that violates third-party rights.
• Impersonating the identity of persons or entities.
• Performing activities that may damage, overload or harm the operation of our servers.
• Performing illegal or fraudulent activities.

LegallyMail reserves the right to suspend or terminate access for any user who violates these restrictions.

7. Responsibilities

User: The user is responsible for:

• Ensuring they have the recipient's consent for sending communications.

• Ensuring Service availability, except for force majeure or scheduled maintenance.

8. Limitation of Liability

LegallyMail will not be responsible for:

• Service interruptions due to force majeure, cyber attacks or circumstances beyond our reasonable control.
• The content of messages sent by users through our Service.
• Indirect, incidental, special or consequential damages arising from the use or inability to use our Service, including loss of profits, data, or business interruption.
• The inability to deliver a message due to causes attributable to the recipient (full mailbox, incorrect address, spam filters, etc.).
• The legal validity of certification in specific jurisdictions, the assessment of which corresponds exclusively to the competent judicial or administrative authorities.

In no event shall LegallyMail's total liability for any claim arising out of or related to these terms or the use of the Service exceed the total amount paid by the user to LegallyMail for the specific Service giving rise to the claim during the twelve (12) months preceding the event giving rise to the claim.

9. Intellectual Property

All content present on the Platform, including but not limited to texts, graphics, logos, icons, images, audio clips, digital downloads and data compilations, is the property of LegallyMail or its content providers and is protected by Spanish and international intellectual and industrial property laws.

Reproduction, distribution, transformation or public communication of any element of the Platform is not permitted without prior written authorization from LegallyMail.

10. Data Protection

In compliance with the General Data Protection Regulation (EU) 2016/679 and Organic Law 3/2018 on Personal Data Protection and guarantee of digital rights, LegallyMail will process personal data in accordance with our Privacy Policy.

11. Service and Terms Modifications

LegallyMail reserves the right to modify, suspend or discontinue, temporarily or permanently, the Service or any part of it, with or without prior notice. We will not be responsible to you or third parties for any modification, suspension or interruption of the Service.

These Terms and Conditions may be modified at any time. Significant changes will be notified to users through a notice on the Platform or by email. Continued use of the Service after such modifications will constitute your acceptance of the new terms.

12. Termination

LegallyMail may, at its sole discretion, suspend or terminate your access to the Service and your account for any reason, including, without limitation, breach of these Terms and Conditions.

Users may cancel their account at any time by following the instructions available on the Platform. Cancellation does not entail a refund of payments already made.

13. Applicable Law and Jurisdiction

These Terms and Conditions will be governed and interpreted in accordance with Spanish law. Any dispute related to them will be subject to the exclusive jurisdiction of the courts of Madrid, Spain, without prejudice to the mandatory rules that may be applicable in matters of consumer and user protection.

14. Indemnification

You agree to indemnify and hold LegallyMail, its officers, employees, and agents harmless from any claim, loss, liability, and expenses (including attorney's fees) arising from your use of the Service, your violation of these Terms, or the infringement of any third-party rights through the communications sent.

15. Disclaimer of Warranties

The Service is provided "as is" and "as available". LegallyMail does not guarantee that the service will be uninterrupted, secure, or error-free. Use of the Service is at your own risk and responsibility.

16. Severability and Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between you and LegallyMail regarding the Service.
